This book represents a prodigious
study of judgment-recognition practices in the Central American
states, and is for that reason alone an important and needed
contribution to comparative law. Distinguished legal scholar
Robert C. Casad details the history and present arrangements
in Central America, compares the Central American system to interstate
judgment-recognition arrangements in the U.S. and the European
Economic Community, and considers important suggestions for reform
in Central America.
This book brings together for the first time in one source,
translated into English, the texts of the relevant code provisions
of each of the six Central American countries, as well as the
text of the Bustamante Code (the multi-lateral treaty) and the
European Economic Community judgment-recognition convention.
"An indispensable research tool for work in Central American
conflicts law. Professor Casad has patiently set forth the necessary
detail but has never lost sight of the related larger political
and economic issues. The work is a fascinating case study in
the relation between these broader issues and the precise legal
questions of jurisdiction and judgment-recognition."--Donald
T. Trautman, Harvard Law School
"Professor Casad brings his expertise to bear on the
meaning and operation of legal concepts which have seldom if
ever been discussed in a comparative fashion. This is the kind
of study that can be of great help both to Central American students
of law and legal process and to U.S. scholars involved in the
process of inter-American legal developments. It also has practical
value for any U.S. or Central American lawyer trying to enforce
a foreign judgment in Central America."--Boris Kozochyk,
University of Arizona College of law
"Professor Casad provides a perspective of vibrant interest
to students of comparative law."--Rudolf B. Schlesinger,
Hastings College of the Law
